City College of San Francisco was sued by its teacher union for allegedly violating the rights of 38 faculty members who were laid off in 2022.

The lawsuit was filed in San Francisco Superior Court by the American Federation of Teachers Local 2121 on Feb. 3.

The college "failed to rehire several of those laid-off individuals as required under section 87744 of the California Education Code," the lawsuit states.

The union identified 13 teachers who should be rehired, according to the education code. The union has asked the court to compel the college to reinstate the faculty members who qualify and provide back pay and benefits.

The college was formally served with the lawsuit last week.

"AFT has provided Interim Chancellor Bailey with overwhelming evidence of the enrollment demand in departments such as English and Chemistry," the union stated in a newsletter on Monday. "But he has refused to act to restore those services in a lawful manner, and the result is a preventable lawsuit and a persistent failure to fulfill our mission."
